Stormy Daniels 60 Minutes interview: All you need to know

In a letter to Cohen on Monday, Daniels offered to return the $130,000 to an account designated by Trump so she could be released from the agreement, which she signed in October 2016.

CNN had reached out to Larry Rosen, a lawyer representing Michael Cohen, Trump's personal attorney, and Jill Martin, a Trump Organization lawyer who has been involved in legal matters related to the Daniels allegations.

Daniels, whose legal name is Stephanie Clifford, recently filed a lawsuit in California, claiming the nondisclosure was invalid because Trump never signed it and Cohen has discussed some aspects of the agreement publicly. On Feb. 22, 2018, Trump's team launched arbitration proceedings and informed Clifford she had "breached the confidentiality provisions of the settlement agreement numerous times".

The decision to surface the secret deal in public court filings carries financial risks for Daniels.

Earlier this month, Clifford sat down with Anderson Cooper for an interview, which 60 Minutes plans to air later this month. The president's attorney is seeking $20 million in damages for the violations.

Avenatti said more detail would be revealed in an interview taped with CBS News' 60 Minutes. "We are not going away and we will not be intimidated by these threats", Michael Avenatti, Daniels's lawyer, said as cited by Bloomberg.

One of the documents was filed by Beverly Hills lawyer Charles J. Harder, who identified himself as an attorney for Trump. He did not explain why he made the payment or say whether Trump was aware of it.

Cohen has denied there was ever an affair and said he paid the $139,000 out of his own pocket.

"And the fact is that my client was physically threatened to stay silent about what she knew about Donald Trump", Avenatti said during an appearance Friday on CNN.

White House press secretary Sarah Huckabee Sanders told reporters Friday that she had no knowledge of the situation and hadn't spoken with the president about it. She asserts that the nondisclosure agreement was void because Trump did not personally sign it. At least two complaints to the Federal Election Commission allege the money was meant to influence the presidential election and therefore amounted to an illegal in-kind contribution to the Trump campaign. "I can't tell you anything beyond what I've already said", he told co-host Joe Scarborough when asked if the threats came directly from the president.
