Is There A Secret Upside To Trump's Tariff?

Republican lawmakers opposing President Donald Trump's imposition of steel and aluminum tariffs said the White House may face lawsuits to block the duties, even as legal experts cast doubt that the cases would succeed.

Speaker of the House Paul Ryan, R-Wis., pauses as he meets with reporters following a closed-door Republican strategy session on Capitol Hill in Washington, Tuesday, March 6, 2018. If U.S. importers and industrial users decide to challenge the tariffs in court, they may try a tactic that stymied Trump's original ban on letting visitors from certain countries enter the U.S. and his executive actions on immigration: using his own words against him. Adding, "There is a major disconnect on the issue of trade between the think tanks and the politicians in Washington, and actual Republican voters across the country".

However, he did applaud the president for recognizing that foreign trade abusers need to be held accountable. "We're going to be very flexible".

"I'm not sure there are any winners in trade wars", said Johnson, who ran a plastics manufacturing business in Wisconsin before being elected to the Senate.

"If they want to do something, we'll just tax their cars that they send in here like water", Trump has said, lamenting European "trade barriers that are worse than tariffs". "Thriving communities turned into ghost towns", Trump said in front of a group of workers before signing the tariff proclamations.

"Members of the Senate, myself included, are concerned about the scope of the proposed tariffs on steel and aluminum and their impact on American citizens and businesses, including many I represent in Kentucky", McConnell said.

Trump also suggested Australia and "other countries" might be spared.

Even if there is an initial victory from a friendly court to stay Trump's tariffs, a case would face hard appeals, according to Mark Warner, a Toronto-based trade lawyer with MAAW Law who practices in the USA and Canada.

Countries could challenge Trump's action in the World Trade Organization, putting this global forum in the uncomfortable position of determining what is in the "essential security interests" of the USA, in accordance with an existing agreement on tariffs and trade. Indeed, he said, Canada is probably already drawing up lists of US products to tax in retaliation.

Once signed by President Trump, the tariffs would go into effect in 15 to 30 days, Navarro said, noting that the proclamation will have a clause that does not impose these tariffs immediately on Canada and Mexico.

Trump has long threatened to pull out of the 24-year-old trade pact if it can't be overhauled and encourage manufacturers to bring factory jobs back the United States. And like the president, Republicans are making political calculations in doing so. But he added, "If they aren't going to make a fair NAFTA deal, we're just going to leave it this way". The prices of a host of products made from steel and aluminum are expected to rise, and several countries have already threatened to impose their own tariffs on US goods in retaliation. "So this hits home for all of us".
