Trump administration sues California over 'sanctuary' laws

California sheriffs have called on the GOP-controlled Congress to intervene and pass federal law to change the state's sanctuary status, arguing that the law ties their hands too tightly and will only increase the chances of another high-profile tragedy.

Brown responded in a statement by calling the lawsuit a "political stunt". But U.S. District Judge Harry D. Leinenweber said the DOJ could require Byrne Memorial grant recipients to certify compliance with the federal immigration law at issue.

The legal action is the Trump's administration's latest attempt to enforce federal immigration laws despite efforts by several states and cities to thwart federal law by claiming that 10th Amendment states' rights supersede the federal government's authority.

It seems plausible that the first two laws could get struck down (and perhaps should get struck down) for reasons that have absolutely nothing to do with federal immigration policies and enforcement.

Wouldn't it be nice if Jeff Sessions wanted to invoke "federal law precedence", over all the states' failing gun controls in order to halt the unrestricted sale of automatic weapons to just about anybody who wants them?

Demonstrators blocked traffic on a busy street but were peaceful as they protested U.S. Attorney General Jeff Sessions' decision to sue California over laws that restrict cooperation with federal immigration authorities.

The federal government, he will say, is "fighting to make your jobs safer and to help you reduce crime in America".

The lawsuit was filed Tuesday in federal court in Sacramento, report Politico, Washington Post, the National Law Journal and the New York Times.

States and cities say their policies are protecting the best interest of their citizens.

"These are uncertain times for undocumented Californians and their families, and this bill strikes a balance that will protect public safety, while bringing a measure of comfort to those families who are now living in fear every day", Brown said in statement.

In an open challenge to President Donald Trump's determined push to halt illegal immigration and expel potentially millions of people who came to the United States without papers, last October Governor Jerry Brown signed legislation making all of California a "sanctuary state".

This policy of not collaborating with ICE is called sanctuary, a term without real legal definition that groups in general criterion of not using public force to pursue immigrants.

The California laws were passed in response to Trump's promises to sharply ramp up the deportation of people living in the USA illegally. The federal lawsuit seeks to undo a series of "sanctuary state" bills the state is trying to pass.

"Tom Homan, the director of ICE, has said recently, 'Being a law enforcement officer is already risky enough, but to give the criminals a heads up that we are coming in the next 24 hours increases that risk".
