The train took a 30 miles per hour curve at 80 miles per hour and plunged off an overpass, sending rail cars plummeting onto a busy highway south of Seattle.

Krzak says they will look at "every angle" of previous incidents, including what Amtrak has done since an Amtrak train traveling from Washington D.C.to New York City derailed in Philadelphia, killing eight and injuring more than 200 people.

The NTSB's findings are based on the locomotive event data recorder and inward and outward-facing cameras on the train.

The recordings included comments by the engineer about six seconds before the derailment about "an over speed condition", the NTSB said in a statement.

NTSB board member Bella Dinh-Zarr said earlier this week that the locomotive's emergency brake went off automatically and was not manually activated by the engineer.

- The crew was not observed to use any personal electronic devices during the timeframe reviewed.


"What kind of brake application did he apply?" While the full investigation will take 12-24 months, the agency has made a few discoveries so far.

The six people Krzak is representing will suffer "long-term" effects from the crash, he said.

The railroad company has committed to covering the entire cost of the derailment, from the medical expenses for the injured, to the costs associated with restoring passenger rail service to road fix.

Data the NTSB provided to AP on Wednesday shows the crashes the NTSB says could've been prevented by positive train control have caused 298 deaths, 6,763 injuries and almost $385 million in property damage.

The rail line where the derailment occurred Monday did not have PTC installed, but rather a system called Centralized Traffic Control - or CTC.

All the while, new high-speed train routes continue to spring into operation without the technology, including the new route involved in Monday's Amtrak crash south of Seattle that killed three people and one in Florida that's expected to start service in the coming weeks.
