Weinstein accuser seeks to set legal precedent with sex trafficking law

Sexual harassment allegations against Don Burke brings back bad memories

Weinstein pulled Kadian into the bathroom, where he forced himself on her, the lawsuit alleges.

"Essentially under the statute, if a USA citizen goes to another country and uses force to entice a person to engage in a commercial sex act, they violate this law", Noble's told NBC News.

Weinstein, who been accused of sexual misconduct by several women, was removed from the members listing on the organisation's website on Friday (24Nov17) and on Monday (27Nov17), Harvey released a statement to Deadline confirming he is no longer a part of the DGA. "He was someone that I thought was going to make my dream a reality", Noble said of her former thoughts of the mogul.

The suit also names as defendants The Weinstein Company and Weinstein's brother Bob, on the basis that they allegedly helped cover up Weinstein's encounters.

"Harvey Weinstein was able to force or coerce Kadian into sexual activity in his hotel room because of his promise to her of a film role and use of his influence on her behalf", states Noble's 11-page federal complaint, filed Monday in the U.S. District Court for the Southern District of NY.

The lawsuit, filed in U.S. District Court in NY, does not accuse Weinstein of labor trafficking or other exploitations commonly associated with the commercial sex industry.

British actress Kadian Noble said in a Manhattan federal court suit that Weinstein "groomed" her by discussing a role with her in London, and went from massaging and grabbing her breasts on a Cannes hotel room couch to forcing other sexual contact in the bathroom.

She alleges Weinstein told her they could work together if she was "a good girl" and did "whatever he wished".

The lawyer representing Harvey Weinstein's latest accuser is attempting to set legal precedent by contending Weinstein's actions overseas make him liable for civil damages under a criminal law against sex trafficking, five legal experts said. She told him to stop but he forced his leg between her legs and began to rub her vagina.

At that point, Weinstein "pulled Kadian closer and groped her breasts" according to the suit, despite the plaintiff's protests.

"Harvey Weinstein actively had no intention of following through with his promise of a role., " the lawsuit said. "TWC employees knew to "take care" of the FOH's", the filing claims. "Mr Weinstein has further confirmed that there were never any acts of retaliation against any women for refusing his advances". If this case ends up holding up in court, it could mean other lawsuits that couldn't have been filed due to shorter statutes of limitations.
