Trump tweets NYC terror suspect 'should get the death penalty'

Federal prosecutors have charged him with two terrorism counts. "But when *you* say it, it makes it harder for DOJ to make that happen".

"They should be forced to suffer and, when they kill, they should be executed for their crimes,"an excerpt from the ad read".

On Thursday morning, Trump reversed course and said it's best to put the alleged attacker through the US judicial system - using some of the same arguments that former President Barack Obama advanced for shutting down Guantanamo.

He added, though, that the case "should move fast" and again called for the death penalty, which could create a hurdle for federal prosecutors in the case.

Trump first tweet came hours after details emerged in a criminal complaint that the suspect allegedly told investigators he "felt good" about carrying out the attack, and also asked to display flags of the Islamic State terrorist group in his hospital room.

The president on Wednesday said he would "certainly consider" sending the suspect in the truck attack that left eight people dead in lower Manhattan to Guantanamo Bay.

He noted over 500 defendants have been convicted of terrorism-related crimes since the September 11, 2001, attacks.

In a tweet, a seemingly angry Commander-in-Chief wrote that the suspect "SHOULD GET DEATH PENALTY".

Trump responded to the attack by pledging to increase vetting of immigrants entering the U.S. He also promised Wednesday to end the visa program that allowed the suspect into the country.

Saipov did not ask for bail and was remanded to federal custody.

But Trump tweets that the judicial process at the Cuban detention center takes longer than the federal court system. But the Trump administration revived it, applying the designation to an American IS fighter captured September 12 in Syria As a candidate, Trump promised to "load up" Guantánamo Bay "with some really bad dudes".

Mark Zaid, a National Security lawyer, commented that Trump's death penalty tirade could constitute "potentially tainting a jury pool" and could give Saipov a solid defense in claiming that the president's statements would breach a guarantee to a free and fair trial.

"Particularly in NY, if he's for it, we're against it", Kuby said.

Saipov was a legal resident of the US, and no one arrested on American soil has ever been sent to Guantanamo Bay.
