US Supreme Court Permits Trump's Travel Ban Enforcement Against Refugees

Supreme Court temporarily allows part of Trump Muslim travel ban

The justices are scheduled to hear arguments on October 10 on the legality of the bans on travelers from six mostly Muslim countries and refugees anywhere in the world.

The judge also determined that refugees from the six countries who already had been accepted for resettlement by a sponsoring agency should be able to enter the U.S.

The order took effect in late June, following a Supreme Court ruling that narrowed the scope of lower court rulings.

The justices said in June that the administration could not enforce the bans against people who have a "bona fide" relationship with people or entities in the US. President Barack Obama said 110,000 refugees should be allowed in the U.S.in 2016, the report said. The question is whether a formal assurance from a refugee-resettlement agency establishes a "bona fide relationship" between a potential refugee and an American entity.


In his first days in office, Trump capped the number at 50,000 as part of a temporary travel ban from seven predominantly Muslim countries.

In response to the Ninth Circuit Court's ruling the Trump Justice Department stated: "The Supreme Court has stepped in to correct these lower courts before, and we will now return to the Supreme Court to vindicate the Executive Branch's duty to protect the Nation". The high court will now review the case, hear arguments and issue a decision. Kennedy ordered those opposing the administration to file court papers by noon Tuesday. A series of court decisions since then have said that order must include people with grandparents and cousins in this country. Resettlement agency directors said they believed their groups would counted as a US entities, some told HuffPost in June, but the Justice Department later clarified that they didn't qualify. The Ninth Circuit had disagreed, reasoning that an agreement to settle a refugee clearly forges a connection between an American organisation and a foreigner seeking refuge. The Supreme Court had specified, in a ruling on June 26, that the government could not exclude foreign nationals - including refugees - who do have close family in this country, or have some kind of formal tie with a US entity.

For now, until October 10, the oral arguments will be heard by the Supreme Court, due to this ruling, the state's appeal becomes pending.

The Justice Department had not sought a stay of that portion of the decision, though it disagreed with the interpretation.
