Maraga said the election commission (IEBC) had "failed, neglected or refused to conduct the presidential election in a manner consistent with the dictates of the constitution". Last year, Gabon's president, Ali Bongo, narrowly won another term in an election whose validity was questioned by global observers, extending his family's 50-year rule.

Odinga's lawyers told the apex court the result declaration forms without security features were falsified and the results contained in them should equally be dismissed.

"It's a very historic day for the people of Kenya and by extension the people of Africa", said Odinga.

And he ordered that a new election be held within 60 days.

He called for calm, saying: "Your neighbour will still be your neighbour, regardless of what has happened". "Regardless of their political affiliation, regardless of their religion, regardless of their color, regardless of their tribe".

The court's decision paves the way for a new race for the presidency between Mr Kenyatta and Mr Odinga. "I'm telling, God is on our side".

But it's not yet clear if the ruling will spark public protests.

Kenyatta, whose Kikuyu tribe has produced three out of Kenya's four presidents, has his main support base in the central region.

"We are ready to go back to the people with the same agenda".

That watered down the winner-takes-all aspect to the presidential contest in a country notorious for corruption, although it didn't ensure taxpayer dollars were any better spent.


Kenyatta is the son of Jomo Kenyatta, Kenya's first president.

In response to the orders providing the opposition leader access to the IEBC servers, Orengo said there were cases of users signing into the IEBC system multiple times against regulations.

"The court's independent review has demonstrated Kenya's resilient democracy and commitment to the rule of law", they said.

"They have committed criminal acts".

Worldwide observers from the European Union and Carter Center, among others, had called the election credible.

Mr. Odinga accused the global observers of moving "so fast to sanitise fraud", and stressed that "their role must be re-examined as it is highly politicised". "Their role must be examined as it is highly politicized and now puts status quo and stability ahead of a credible election", he said.

The opposition says 100 people were killed, while police gave a death toll of 10 for Nairobi. August's elections, that he lost to President Uhuru Kenyatta, were widely expected to be his last shot.

What have the global monitors said? "We are ready but can not repeat the election with this commission". His department is responsible for voter-identification and result-transmission technology.

"This is a triumph for the people of Kenya".

The ruling adds uncertainty to the Kenyan economy, according to Emma Gordon, senior East Africa analyst at risk consultancy Verisk Maplecroft.
