The defective glasses sold by the Seattle-based company has landed them in a soup as they're facing a class-action lawsuit from two SC residents - Kayla Harris and her fiance Thomas Corey Payne - in the federal court.
Solar Eclipse was a great opportunity for anyone looking to make quick bucks and given the high number of sellers offering the glasses, it sure would've been hard for the company to verify as many products but that doesn't make up for a valid excuse.
Viewing an eclipse with the proper eye protection is imperative to prevent permanent and irreparable eye damage.
The lawsuit says that Amazon's August 19 recall of the glasses was "tragically too little, too late".
The legal action comes only a little more than a week after the 21 August total solar eclipse, and a little more than two weeks after Amazon sent out a highly publicised email warning customers about potentially unsafe glasses.
After viewing the once-in-a-lifetime lunar event, Payne and Harris claimed they began to experience eye watering and headaches later that day, the lawsuit says. "Thereafter, both plaintiffs began to see dark spots in their line of vision, suffered vision impairment, including blurriness, a central blind spot, increased sensitivity, changes in perception of color, and distorted vision".
But it's not like Amazon wasn't aware of this issue. But such poor-quality eclipse glasses could've caused headaches and eye damage to the wearer. They did not release information about the scale of this recall, nor have they offered comment on this most recent suit.
The plaintiffs also seek an order certifying the class, exemplary and punitive damages, compensatory damages, treble damages, attorneys' fees and costs, and a refund of the purchase price.
In the lawsuit, the couple claims, the glasses were defective and that Amazon was negligent in allowing them to be sold.
Judge Patrick Michael Duffy has been assigned to the case.
