Supreme Court sides with same-sex couples in Arkansas suit

Both couples received the birth certificates they wanted when they won in trial court.

The unsigned opinion reversed an Arkansas State Supreme Court ruling.

The high court's decision on Monday (26 June) comes on the second anniversary of same-sex marriage being made legal in all 50 U.S. states.

According to the American Civil Liberties Union (ACLU) of Arkansas, same-sex females couples who had children before the legalization of same-sex marriage were required to get a court order in order to list their names on the birth certificate of a joint child. However, the Arkansas rule applies even to married opposite-sex couples even if the couple is fully aware that the mother's husband is not the child's biological father.

But such acts of resistance have largely faded way, and same-sex marriage is now treated as a routine occurrence across the U.S. According to the Williams Institute at UCLA School of Law, there are now more than 547,000 same-sex married couples in the U.S., including at least 157,000 couples who married in the past two years.

'Today's decision means that millions of married same-sex couples across the country can breathe a sigh of relief, knowing that this type of blatant discrimination against their families will not stand, ' said NCLR Family Law Director Catherine Sakimura.

The poll, which comes two years after the Supreme Court ruling that legalized same-sex marriage nationwide, found that 62 percent support it now and 32 percent oppose it. This, the court ruled, is one of the rights granted to same-sex couples along with marriage.

"The Arkansas Supreme Court's decision, we conclude, denied married same-sex couples access to the 'constellation of benefits that the state has linked to marriage, '" the court said Friday. "The statute in question establishes a set of rules created to ensure that the biological parents of a child are listed on the child's birth certificate". Neil Gorsuch, the court's newest justice, joined Clarence Thomas and Samuel Alito in dissenting, suggesting that he may be a reliable critic of LGBT protections in future cases. "We are truly equal as families now". "But nothing in Obergefell spoke (let alone clearly) to the question whether...the Arkansas Code, or a state supreme court decision upholding it, must go", Gorsuch wrote.

In a statement, the president of the Arkansas Family Council said the court through its decision is asking "Arkansans to ignore basic facts about biology".
